Design conditions in the absence of obligation to draw up a detailed plan

Design approvals are required for the preparation of a construction project for a building or a structure of significant public interest (hereinafter referred to as a significant structure) that is subject to planning permission, where there is no obligation to prepare a detailed plan.

The local authority grants planning permission for a building or important facility:

  • for the construction or establishment of;
  • to expand more than 33 percent of its originally planned capacity.

The project design conditions take into account:

  • the built environment, including the building style, at the site of the building or significant structure;
  • that the granting of planning conditions is not contrary to law, the rights of persons or the public interest;
  • the conditions laid down in the general plan.

 The design conditions shall designate, where appropriate, the building or substantial structure:

  • purpose of use;
  • the maximum number allowed on the site;
  • location;
  • the maximum permissible floor area;
  • the height and, where appropriate, the depth;
  • architectural, structural and design conditions;
  • the possible location of the building needed to serve the land or water;
  • the need to carry out a building survey;
  • the principles of landscaping, maintenance and traffic management.

Application for project conditions in the absence of obligation to draw up a detailed plan

The application for project conditions and related documents are submitted to Valga Municipality electronically. building register via. Exceptionally, if it is not possible to submit the application and related documents through the building register, they are submitted to the Valga Municipality Construction and Planning Service, which enters the data in the building register. A state fee must be paid when applying for project approvals.

The competent authority will issue the design permit within 30 days of the date of the application. Where the competent authority decides to organise the procedure in an open procedure, the design authorisation shall be granted within 60 days of the date of submission of the application.

The application form for project specifications must include at least:

  • position plan
  • it is advisable to include outline drawings of the proposed construction works.
Project conditions where a detailed plan exists

Where a detailed plan exists, the local authority may, in justified cases, grant design conditions for the preparation of a building project for a building or an important structure subject to a building permit, if:

  • more than five years have passed since the detailed plan was adopted;
  • substantial new facts have come to light since the adoption of the detailed plan, or the planning area or its area of influence has changed significantly, which mean that the detailed plan can no longer be fully implemented; or
  • since the adoption of the detailed plan, there have been changes in legislation or planning regulations which have a significant impact on the implementation of the detailed plan.

The project design conditions take into account:

  • the built environment, including the building style, at the site of the building or significant structure;
  • that the granting of planning conditions is not contrary to law, the rights of persons or the public interest;
  • the conditions laid down in the general plan.

No design conditions are granted:

  • to amend the substance of the planning solution established in the detailed plan,
  • supplementing the detailed plan amending the general plan, 
  • for the granting of additional conditions to buildings permanently connected to the shore or functionally linked to the shore of a body of public water,
  • to supplement a specific national or local plan.

The design conditions shall specify, where appropriate, the detailed design of the building or essential structure:

  • the intended use, including the proportion of the plot's underlying land use for residential or office uses, if both of these uses have been previously provided for in the detailed plan;
  • the conditions of the building envelope, including any increase, reduction, rotation or shifting of the building envelope, but not more than 10 per cent of the original design;
  • modification of the height and, if necessary, the depth, but not more than 10 % of the original solution;
  • architectural, structural or design conditions;
  • the possible location of the building needed to serve the building on the site;
  • the need to carry out a building survey;
  • principles of landscaping, gardening or traffic management;
  • the type of building in the planning area, including the layout of the plot, if it is linked to the construction of a building complex, provided that the building right originally granted in the planning area is not changed.
